As I understand it, this may be a legal reference if "item" is an element
of the application. Which is the case with Finder (though the "item" term
may be considered not the best choice.)

Now (as you know) it depends on the programmer whether an element will be
accessed by name, by index, and/or by a "whose" clause.

In the specific case, the Finder's "item" (OS 9) is said to be accessed
only by numeric index or name, so "items ... whose ..." should error.
