The answer is quite simple - Finder is officially no longer
responsible for maintaining processes in Mac OS X. It's just an
application like any other.
Very true.

You should use application "System Events" from within AppleScript
to work with global things like processes.
Not so sure:

In theory, you're not supposed to even know that System Events
exists, and you're not supposed to talk to it directly, though the
former is very difficult to arrange, and the latter still works.
What you're supposed to do is talk to the Finder like you used to,
and AppleScript will arrange things behind the scenes. If you
address System Events directly, you're putting yourself at risk of
breaking in the future, should we decide to move/rearrange/destroy
System Events. Not that we have any immediate plans to do so, but
you never know.
Now I'm as confused as ever.
