Thanks to those who replied - on and off list.
I apologize for missing the similar thread started by Timothy Bates on 11/04/02.
His suggestion about the insertion location can be made to work after a few attempts at enigmatic coertion sequences.
The interpretation that the column to the right represents an open folder with nothing selected does not mean that Apple thinks there is no finder selection.
My reasoning comes from the observation that a single selected folder is highlighted in a different color than that used for open folders in columns to the left. If one selects a file in the column to the right it acquires the highlight color and the folder in question reverts to a light gray matching other open folders to its left.
If the folder colors the folder icon with the selection color it should be considered selected. What I really need is for someone to say that the empty list has been recognized as a bug and is in the process of being fixed. Does anyone have access to the bug list? 10.2.2?
