Deleting a file that is already in the trash...

When I attempt to script the Finder to delete a file (or move to
trash, the result is the same) I get an error if a file with that
name is already in the trash.

I tried:
move FileRef to trash with replacing

but still go the error.

Is this a 10.2 idiosyncracy or am I missing something obvious?
