Illustrator CS - Save Bug

Can someone else check if the following errors:
tell application "Illustrator CS"
save current document in file ((path to desktop folder as string) &
"temp.ai")
end tell
Whatever different way I try it I get an error "Can't save the illustration.
The file couldn't be found. ID = -43". Followed by another error dialog "The
object Save As is not currently available."
