Problem suppressing PhotoShop 7 dialogs

I'm having a problem suppressing a dialog box in PhotoShop. When opening a
particular file from an AppleScript I get a dialog warning that the file has
file info which cannot be read and will be ignored. I'm opening the file
with a statement "open theFile showing dialogs never" and even preceding it
with a "set display dialogs to never" statement but I still get it. I've
tried to set PhotoShop not to show it by opening the file and checking the
"don't show again" box before dismissing the dialog, but that only works
for that session and the next time PhotoShop is opened the behavior returns.
And it's the same is OS 9.2 or OS 10.2.3. Anyone got any ideas?
PhotoShop 7.0.1
Scripting Support 1.0.2
OS 9.2.1
AppleScript 1.8.3
Thanks,
John
