This is, in fact, a limitation in the target application (Photoshop). We
are hoping to be able to address this in a future version.

To be fair, we added scripting on top of an application which had been
designed from the beginning to be driven from a graphical user interface
(where document order doesn't really matter since you are always working on
the front most document), where as InDesign and InCopy were designed from
the beginning to be scriptable.
