replacing an image in photoshop

I'm writing a script that will digimark an image and save that image with the same name. pretty simple right? well, i can't get photoshop to automatically replace the image without throwing up the dialog "Replace Files?" and having to hit ok. I need for this to work independent of human intervention. Any thoughts...
