In general, if you believe that an Apple product is not working as documented, file the bug. If the engineers disagree, they'll close it as "not a bug." If you understand that "busy status" means a file is open (and therefore should not be read and cannot be written or deleted), and that's not what it means, then I say it's ripe for a bug report.
If you're wrong, then the "fix" is to change the dictionary and/or documentation to make the real meaning of "busy status" clearer. Either way, filing the bug doesn't hurt. File away.
