You probably neglected to turn on access for assistive devices in the
Universal Access pane of System Preferences.

Your script works fine here. It returns a list containing the menu bar
element and the window element, as expected. PreFab UI Browser lets me
navigate the window's elements and generate GUI Scripting statement for
them.
