Display Dialog is not frontmost in the Finder...

Hi,
the following script displays a window (as requested), but the OK button have
the 'front window' look (not disabled), but a keypress on the Return or Enter
key does not do what one expect. In fact, the dialog is not 'frontmost' and so
if you click in the window, it comes frontmost and then you can press Return or
Enter to fire the OK button.
tell application "Finder"
display dialog "Is it a bug ?"
end tell

Nota: running Tiger let me see... no less than two (YES: TWO) frontmost windows
at the same time (three times in different days, either after cold or hot
reboot...) go figure :(
