In prior versions of AS, no matter what, the folder was created if it did not exist when the 'path to' command was executed. This was true in OS9 and in early OSX, when I remember several of us worked on some 'path to' scripts for referencing the full list of blessed items.

It wasn't broken; the option simply didn't exist until relatively recently -- 10.3 (Panther), to be precise. Prior to that point, "path to" would always create the folder if it didn't exist.
