FWIW, Finder is able to do something on the desktop with no path/
directory information at all. Since the desktop is a property of the
Finder, items directly contained by the desktop can be considered
elements of either the desktop or of the Finder application. So even
this should do the job:
tell application "Finder" to make new folder
