I had a similar problem summoning the spell checking panel (cmd-: on the Swiss French keyboard). The panel appears correctly when manually typing "cmd-:" but does not appear when invoked through applescript 'keystroke ":" using command down'.

You might get better results by using XSpell a free osax allowing you to have access to the built in spell checker of Mac OS X
