No, not intentional.  In fact that works.  It just proves I'm losing my mind.  But my plea is that I was misled by the error message, "can't get file ..." which led me to believe there was some wierd coercion problem.  What finder couldn't get was not the file but the folder.  I don't know why a more informative error message couldn't be used.  Sorry for wasting your time.
