One would think that if the "path to frontmost application" was going to identify the frontmost visible application, then one would indeed expect that the "frontmost application" should return the same thing. It's logically inconsistent if they aren't one and the same application. I'd say it's a bug.
In terms of the UI, which is, I presume, the context and motivation for even defining the attribute frontmost, it makes little sense to me that FBAs that stay invisible should show up as frontmost in any query. And if they can, then it imposes some exceptions that can create difficulty. And the fact that it happens inconsistently (comparing the three script running methods I used) makes it harder to get consistent performance from machine to machine (user to user), depending on the method of launching.
