With my original code, if the document was in CMYK you could then convert the colour to CMYK from spot.. Forcing it to open as CMYK was the only thing I was unsure how to do.
I just testing the "forcing CMYK without dialogs" thing too.. and got the same result as you.. sigh.. I'm lost. :)
