   It works now. Making the ActionScript into a Droplet and then calling it from AppleScript would work, but I want to keep it simple when possible. I may go that route on scripts that I can not do simple like this one. Simply expanding the ‘tell System Events’ line made it all better.

FileSample to choose folder with prompt "Please select an input folder."
set folderName to name of (info for FileSample)
tell application "Finder" to set theFiles to files of folder FileSample whose name extension is in {"eps", "psd"} or kind contains "Adobe Photoshop EPS file" or kind contains "EPS" or kind contains "Photoshop" or kind contains "PSD"

   tell application "Adobe ImageReady CS2"

       open (oneFile as alias)

I don't know if this will help you in your situation, but I have had good
results saving my actions as droplets and then telling my files to open
using the droplet as the application. It always closes the files when done.
