As of 10.5 you can, using "make new".

Do you have a line of code that's known to work? I'd like to see it.
I just tried, in 10.6.3, ...

set deskAlias to (path to desktop) as alias
tell application "System Events" to make new property list file at (deskAlias as text)

and got nothing but error.
