I don't follow:
If there are no open windows (minimized or otherwise), I get a list of selected icons on the desktop (or an empty list if nothing on the desktop is selected).
If there is an open visible window , I get no result at all regardless of whether anything in the window is selected.
Under no circumstances that I can think of, I never get the error dialog.
