set volume from shell

Hi all,
I got a problem with 'set volume 8'.

When using in AppleScript Editor it works great.

But when trying to use itlike this:
set theCMD to "osascript \"set volume 8\""
do shell script theCMD

I get this error:
error "osascript: set volume 8: No such file or directory" 

I also tried single quotes, no quotes it´s always the same.

Why this: 'No such file or directory'?

I´m using do shell script pretty often and know how to use it.

I´m lost.
What is wrong here?
