Toolbar Or Not Toolbar

I've lust noticed this in Lion (10.7.1) ...

I have some folders that, when opened manually by double-clicking, do NOT show the Toolbar.
And I intend that they never show the Toolbar.

However, when I open any of these folders via ...
1. An AppleScript (tell application "Finder" to open ...)
2. An alias file (double-clicked)
3. A .fileloc file (double-clicked or selected from a Dock menu)
4. A folder selected from a Dock menu

I ALWAYS get a folder with an unwanted Toolbar.

This seems to be a bug. Has anyone noticed this?
