When is a window not a window?

Hi,

One of my favorite scripts quit working.

Finder window in List view, Toolbar hidden.
The command in question is;
tell application "Finder" to  tell window 1
set {leftSide, topSide, rightSide, bottomSide} to bounds
...

Now it gets the bounds of the finder window minus the Title bar.

Same result in both ML and Lion.

Am I missing some obscure "Feature"?
