If I omit the line

close document 1 saving yes saving in thePath

and try to save manually, I do get the error you describe. It’s related to OSX's ‘autosave’ feature, and I’d put that down as a bug with autosave rather than text edit. I have encountered similar problems with Script Editor itself in the past.
