Virginia Nabs Spammer on Felony Charges
Word has it that Virginia will prosecute as many spam cases as
possible before the impending enactment of the new federal law.
As I was posting my note to the list last week, law enforcement
authorities were executing a search warrant to arrest Jeremy Jaynes
in Raleigh, North Carolina, charging him with four felony counts
of using fraudulent means to transmit unsolicited bulk e-mail.
Extradition procedures have delivered Jaynes to Loudoun County,
Virginia for prosecution, where the grand jury indicted him on Monday.
Jaynes is listed as the eighth-most prolific spammer by the Register
of Known Spam Operations (ROKSO) available on the spam information
website www.spamhaus.com. He faces four felony charges, each carrying
punishment of one-to five-years in prison, a fine of up to $2,500, or
both.
The indictment alleges that spam sent on July 16, 19 and 26 exceeded
10,000 messages during each 24-hour period. According to Lisa
Hicks-Thomas, director of Virginia's computer crime unit, the spam
included "penny-picker stock schemes, mortgage interest rate ads and
an Internet history eraser. And, according to the antispam group
Spamhaus, Jaynes is ranked as No. 8 on the top 10 worldwide spammer
list.
Virginia's law makes spamming a class 6 felony and includes asset
forfeiture provisions to allow law enforcement authorities to seize
any assets or proceeds obtained through the illegal spam operation. It
also enhances penalties for violation of Virginia obscenity laws
through the sending of illegal e-mails. The legislation authorizes the
Attorney General's Computer Crime Unit to investigate and prosecute
spammers if illegal e-mails are sent to, from, or through any computer
or computer network located in any Virginia locality.
