I listened to the iPhreaks show this morning where Ben Scheirman was talking about a very similar use case where a social app would be able to download data in the background triggered by a silent notification. If you're interested:

Ben was a little vague on the details but if we consider this info, then it is at least considered to be a possible use case by Apple. Starting a scan may not fall in the same category as a network request as in this case there may not be a well defined end time for the action but I wouldn't drop the idea completely. Certainly, this solution may to allow the app to start a scan every whatever few minutes.
