You are correct -- the finder does not replace stuff by sending it to the trash. Not sure what made me think it did. In any case, I sense double-checked whether the Dock, etc, is broken in with the steps I indicated. It is, but the original does not end up in the trash.

Oops.

I have also received email from a couple of folks that indicate the behavior is not broken on their machine -- that is truly odd as I am able to reproduce it consistently on a system with a fresh 10.2 install, including a freshly created user account.

You wrote a few times, though, that when the Finder asks if it should replace a file, it moves the replaced file to the Trash. This is just wrong  or at least it is wrong for Mac OS 9 and Mac OS X up to 10.1.5 Client (I don't know for Jaguar). When you replace a file through the Finder, the file is immediately deleted. There's no "go to the trash" step.
