It isn't Apple's decision to make [entirely] or problem to fix. Finlay is
a minor [in the eyes of US law-- Apple is a US company] and, as such, his
participation very likely falls under the domain of the Children's Online
Privacy Protection Act which has some very real legal implications in
terms of ownership of content and how content produced by Finlay can be
used.

The bottom line is that even if Apple were to put forth some kind of a
clause via which Finlay's parents could OK his participation in ADC,
contributions to Darwin would still fall under COPPA or, at the least,
there would be risk that Apple would have to invest an arbitrarily large
quantity of lawyer time/$$$ to ensure that COPPA would not apply in such a
case.
