While it may make little sense in most circumstances I can see where there might be times that it would be a MORE straight-forward way of doing things than other solutions. Take the old OS9 Apple menu for instance. It let you open the Control Panels folder by selecting that menu item instead of one of the items within the menu. Very nice, indeed (and something that I miss).

I could see this being used in Safari, for example, to open all the bookmarks in a submenu,each in separate tabs. (Just an example, mind you.)

While it may not be legal in the HIG I can see CERTAIN circumstances where it could be more user friendly to allow this capability. Notice that I don't say "all circumstances."
