Yes, it's a good thing to have the new technologies tried out before they're finally released. That's why Apple have software seeds to selected developers.
However, if people cannot respect the terms under which Apple conducts these seeds they are likely to limit or completely remove the seeds. Would you like that to see that happen?
In any case, it's up to Apple to set the rules for the use of their software. You can't just say "hey, I don't plan to play by the rules - but I'll still snatch a copy of the software". That's childish. If you don't like the rules, send feedback, don't break the rules.
I agree that there are things that could be improved with regards to the software seeds, like private discussion forums for NDA participants. But you should send such feedback to Apple, since it's OFF TOPIC for this list.
