It still has to be considered a non-standard way to implement a toolbar in Mac OS X. I wonder if the indentation of the menu items for the toolbar in the View menu is according to HIG? Looks weird - is *any* other application using indented menu items?
Why not simply use NSToolbar? They would gain a familiar appearance and much improved abilities with regards to customization.

That said, keeping the toolbar at the top of the window is still so very much better than iCal, iPhoto et. al. that sticks it at the bottom of their window - what's up with that?

Sure they do. Look at the view menu. Also, no toolbar button in titlebar.
