Floating window

I am working on a statusBar application that will open a panel. This application only uses 1 .nib file that contains the statusBar's NSMenu and also contains the NSPanel. Everything works great. Except that I would like this panel to be a floating panel in front of all other applications. I have seen how this is done but can not get this to work where the NSPanel does not activate on startup. Has anyone been able to get this to work? If so I would appreciate some help.
