set NSRunAlertPanel to be the frontmost window

I have created a Status Bar to launch applications from that works fine. I have a problem though. I am calling on NSRunAlertPanel but I can't find any documentation on how to set this to be the front most window. It displays the alert panel fine except if you have a different application that you are currently using and choose the status Bar item to launch another application the alert panel stays behind the current application you are using.

Is there a way to get this alert panel to be the front most?
