I think it was in the book "Tog on Interface" that there was a discussion of
a drawing/painting app that switched menus around when the user switched
between drawing & painting modes. If the user is cognizant of the mode
switch, changing the menus is perhaps not so bad - it is analogous to
changing to a different application.
In the discussion referred to above, it was found (upon questioning) that
many users didn't consciously notice the change in the menus - they always
found the menus items they expected to find (for the mode they were in).
