Invisible menu bar still locks the area?

Hi all,

if I send the setMenuBarVisible:NO message to NSMenu, the menu bar
disappears indeed... *BUT* still it is not possible to drag any window
to the (now empty) space?!? (OSX 10.3.3, haven't tried elsewhere)

Is that a known bug, is there a workaround?
