NSError and Jaguar

I'm developing a project using WebKit that should run on OS 10.2 and 10.3

I know that WebKit is available to users of 10.2.7 or 10.2.x + Safari 1.0.
However, WebKit uses NSError which, according to the documentation, is only
available in 10.3. Somewhere it says 'publicly available'.

Can I assume use NSError works safely on OS 10.2?
