I think so, but I also think you misinterpret the LSUIElement property:
"[LSUIElement applications] typically run as background applications,
they can come to the foreground to present a user interface if desired
[...]". I.e. it has no Dock icon nor exists in the Force Quit window,
so the user will see it as bg-only until you open the requester.
