That's not at all what I was saying; Xcode 2 ships on the same DVD-ROM
as Tiger, which Apple have already shipped.
By "out there" do you mean the accidental week-early release of Tiger
by PCMall and ClubMac? If that's so, then the NDA still applies,
because it says it ends once material is made available to the public
*by apple*, which isn't what happened in this case.
Actually, that's not the way these clauses work about as you say...
Anyway, this is a reasonably pointless argument.
Indeed, since you can now walk into the Apple Store in Tokyo and buy a
copy of Tiger (and a dual 2.7GHz G5 :-) see http://www.apple.co.jp/
