Setting the Desktop Background: Sample Not Working?

I have tried the "DeskPictAppDockMenu" sample form ADC (1), but on 10.4.2 (or any system I had at my disposal for testing) the Desktop Background Picture remained unchanged. No errors are reported.

Am I overlooking something?

Is the sample broken?

Is there a new, better, cooler way to set the Desktop Background picture?
