Problems with NSToolbar in a modal window

I am having problems with a toolbar that is in a modal window. The visible items work fine, items in the overflow or all items in "Text Only" fail to call their actions. I have tried setting a menu representation and that doesn't help. Has anyone seen this or found a work around? A simple project that reproduces the problem is at http://www.thehousleys.net/ToolBarProblem.zip
