My problem appears when close the preferences window, that released this resource. How can make to anchor permanent this menu, as some apple preferences, when the preferences window is closed?

When the preferences window is closed, all the resources assigned to your preference pane will go away - the status bar item included.

You will need to implement a separate (faceless background) application that keeps running to host the status menu.
