That was my first reaction too, but I thought I might offer a solution
before asserting how it couldn't be used :). My own current-shipping app
makes use of some older (Tiger-OK) third party Core Graphics frameworks
that actually look a lot like Leopard Core Animation effects, and I've
been of half a mind to remove them just to be on the safe side. I know
I'll likely rebuild them in true CA code but October is near enough I am
in no hurry whatsoever to stick even an Alpha build out there with my
(non-NDA) testers.

Based on my discussions with ADC, they're really serious about you (and
I mean this a plural sense) not releasing anything that has been
produced by something (e.g., the Leopard versions of Xcode or IB) that
is still under NDA. In fact, I believe that the ADC Terms and
Conditions say something to this effect.
