I'm not a lawyer, and this should not be considered legal advice.
I work under NDA's frequently as a result of my career. The legal team for my employer has coached me basically with this information:
If you are working with a team, all under NDA, then it is fine to discuss specifics with other team members.
If you are under the NDA covered by *our* (i.e., my employer's) master services agreement with the client, than you may discuss specifics with any employee of the same company.
If you are under an individual NDA, and the company is not, consider these issues:
* No other employees of my company can be assumed to be under the same NDA,
and therefore that information should not be disclosed to them. Employees
of the client may or may not have the same NDA. Find out if they all do.
* If the information was disclosed among a group of people in a live setting,
you may discuss with other people in the meeting.
* If the client introduces you to someone and you are to work together
on the topics covered by the NDA, you may discuss it with that individual
*If the information is disclosed to you privately, than you may discuss it with the
individuals who disclosed it to you. Other disclosure should be scrutinized.
If you are in a team situation, get clarification regarding who else can and should
know about this topic.
I understand and respect the concept of an NDA, but I still hate having to go through the
required legal hoops to make sure I abide by them. I feel dirty every time I have to say politely
"I'm sorry, I can't talk about that". :-<
