disabling close button in 10.3.9

Hi all,

I am implementing an application which supports both 10.4 and 10.3.x.  At some point in my application i am disabling the window's close button. The problem is, the close menu item of file menu is not getting disabled in 10.3.9 however it works fine in 10.4.8.
Please help me if any one knows how to disable menu item in 10.3.9
