I have filed this under Radar #5712323. Now I am desperately searching for a workaround.

Let me first thank you for filing this bug and providing a sample that reproduces it. I've modified the sample with the recommended workaround and put it here: http://homepage.mac.com/gershwin/ MenuView.zip
