Floating NSPanel and runModalForWindow: problems

I have a floating NSPanel that sits on-top of all the other windows in the app like it should, but once runModalForWindow: is called with the floating panel as the argument, the panel no longer stays on top of normal-level windows. This just started happening after upgrading to 10.5.6. Has anyone else noticed this?
