If, as you say, your question was also applicable to operating system that may be discussed on an open mailing list, you could have omitted reference to iPhone OS 4.0, and responses would not, even implicitly, have to be about iPhone OS 4.0.
You now imply you meant to ask about the iPhone OS 4.0 beta 2 _SDK_, not the operating system itself. The SDK is likewise under nondisclosure, so that doesn't change anything.
