What version of OS X? Almost sounds like you're describing a popover, as in Lion. But still, the comments pointing you back toward Mac UI conventions are likely correct, in that there's no way a menu-like thing should be an application-modal window. In fact, a child window or floating panel sounds more & more like a better way.
