So I rebooted and can confirm that on 10.7 I have the same problem, but not on 10.8. Your workaround is maybe good, but I do suggest you stay away from path APIs and only use NSURL APIs. Also fileExistsAtPath: is mostly useless, just try to copy the file, if it's there already, you'll get an error, which you can ignore.
