Keeping a menu enabled with a modal dialog running

Hi all,

I have a menu item that should be available in my app no matter what. Currently its target is the app delegate and it does not go through First Responder. However, it is greyed out when a modal dialog is running which is annoying. Is there a way to ensure that such a menu can still be responded to (enabled) when the modal dialog is up?
